A recent issue of HUD USER's RBC Breakthroughs highlights a regulation in San Diego that makes some condo conversions subject to the city's inclusionary zoning requirements, in an attempt to preserve affordable rentals.  Specifically, the project is subject to IZ requirements if the new homeownership units will be targeted on households earning 150+ percent of AMI.  In addition the conversion is prohibited if it affects more than 3 units in a single structure, or 10+ units in multiple structures, which are occupied by low- or middle-income households in the city's Coastal Zone (unless developers agree to one-to-one replacement).  Does your community include condo conversions in its inclusionary zoning ordinance?  In this economic downturn, is this currently a concern?
